Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WakaHustle mobile apps, website, and related services (together, the "Platform"), operated by WakaHustle from our registered address at 7 Etokeren, Ikot Ekpene, Akwa Ibom State, Nigeria ("WakaHustle", "we", "us", "our"). By creating an account, posting or accepting an errand, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Platform.
1. What WakaHustle is
WakaHustle is a two-sided marketplace that connects Requesters — individuals, homes, and offices who need an errand run, a task done, or a purchase made — with Runners — independent individuals who accept and complete those errands, and who may also operate a Registered Provider (small shop, kiosk, or skilled-trade) listing through the same app.
WakaHustle is a marketplace facilitator, not a party to the errand itself. We provide the technology that matches Requesters and Runners, process payments through our licensed payment processor, and hold funds in escrow until an errand is confirmed complete — but we are not the seller, buyer, or provider of record for the goods purchased or services performed by a Runner, and we do not control how a Runner carries out an errand. Runners are independent contractors, not employees, agents, or partners of WakaHustle (see Section 6).
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract under Nigerian law to create an account on WakaHustle, as either a Requester or a Runner. Runner age is cross-checked against the National Identification Number (NIN) record supplied at verification; Requesters confirm eligibility by accepting these Terms at signup. We may refuse, suspend, or terminate any account we reasonably believe belongs to someone under 18 or otherwise ineligible.
3. Your account
You agree to provide accurate information when creating your account and to keep it up to date, to keep your login credentials and any one-time passcodes confidential, and to notify us promptly of any unauthorised use of your account. You are responsible for all activity that happens under your account, whether or not you personally carried it out, except where that activity results from our own fault.
Runner verification
Before a Runner can accept any errand, they must complete identity verification — submitting their NIN or BVN and a live selfie check through our verification partner. Certain higher-risk errand categories (for example, unsupervised in-home work, hospital companion assistance, or tutoring involving minors) require an additional, enhanced verification level, including address confirmation and an emergency-contact record, before a Runner may accept them. We may decline, suspend, or revoke a Runner's verified status at any time if information provided proves inaccurate or if we reasonably believe continued access poses a safety risk.
4. Posting and accepting errands
A Requester posts an errand by describing the task and funding two separate amounts before a Runner is dispatched: the errand cost — what's needed to buy the goods, materials, or service the errand itself requires, passed through to the Runner in full — and a service charge — what the Runner earns for their time and transport, subject to a platform-enforced minimum. A Runner can see both amounts, and the total, before deciding whether to accept — WakaHustle does not assign, schedule, or require a Runner to accept any specific errand, and a Runner is free to go online or offline and to accept or decline offers as they choose.
Once an errand is funded, WakaHustle facilitates matching a nearby, verified, available Runner. Depending on how the errand was posted, matching happens either automatically (nearest eligible Runner) or through a bidding window where Runners submit offers for the Requester to choose from.
If it turns out more money is needed to cover the errand-cost portion of an already-matched errand — for example, the actual price of an item is higher than first estimated — a Runner may request a top-up covering only that shortfall; a top-up request never applies to the service charge. You'll see the amount requested and the Runner's reason, and can choose to pay it or decline it. If you decline, or don't respond within the response window, the Runner may release the errand without any penalty to themselves, and it returns to being matched with another Runner. Separately, and at any time, you may release your currently matched Runner and be matched with someone else instead — with no fee, and your escrowed funds stay in place.
5. Payments, escrow & fees
All payments on the Platform are processed by Paystack, our licensed third-party payment processor — WakaHustle never stores your full card details. When you fund an errand, your payment is held in escrow and is not released to the Runner until the errand is marked complete and you confirm it (or, for eligible scheduled errands, at the milestone points disclosed to you at posting).
WakaHustle deducts a service commission from the service-charge portion of a completed errand only — the errand-cost portion (what you're paying for the goods, materials, or service itself) is never commissioned and is passed through to the Runner in full. The applicable commission is disclosed to Requesters and Runners before an errand is accepted and is factored into what a Runner nets — there are no hidden add-ons beyond what is shown at checkout. WakaHustle may also charge Runners a subscription fee for optional higher-tier account features; any such fee is disclosed before you subscribe.
A Requester or Runner may leave funds in their in-app WakaHustle balance or withdraw them to a supported Nigerian payout destination (currently Opay, PalmPay, or Moniepoint). A withdrawable balance left unused for an extended period may be automatically transferred to your saved payout account — this protects you from funds sitting unclaimed, and does not change how much you are owed.
Because card payments can be subject to a chargeback initiated by a cardholder's bank, WakaHustle may hold back a small rolling reserve from a Runner's payout for a limited period before it becomes withdrawable, to cover that risk. This does not reduce what you are ultimately owed absent an actual successful chargeback or fraud finding.
6. Runner independent-contractor status
Runners are independent contractors. Nothing in these Terms, the Platform's tier system, bonus programme, or the way errands are offered creates an employment, agency, joint-venture, or partnership relationship between a Runner and WakaHustle. A Runner sets their own availability, chooses which errands to accept, and is responsible for their own tax, insurance, and regulatory obligations arising from work performed through the Platform. WakaHustle does not direct or control the manner in which a Runner performs an errand, beyond the safety, verification, and conduct standards set out in these Terms.
7. Cancellations, no-shows & refunds
We know errands don't always go as planned. The table below sets out what happens depending on when and why an errand is cancelled. Where a Requester chooses to cancel an errand and request a refund, a flat cancellation fee applies, deducted from the refunded amount — this is different from simply releasing your currently matched Runner to try someone else (see Section 4), which carries no fee at all. A refund credited to a Requester under this section goes to their in-app WakaHustle balance — usable immediately toward a new errand, or withdrawable to a bank account — rather than an automatic reversal to the original card.

A simple transaction receipt is generated automatically for every completed errand and is available in-app.
8. Ratings, conduct & prohibited activities
After an errand is completed, both parties may rate and tag each other. Ratings are double-blind — neither party sees the other's rating until both have submitted one or the submission window closes — to discourage retaliatory or copy-cat reviews.
You agree not to, and not to attempt to:
- Use the Platform for any unlawful, fraudulent, or deceptive purpose;
- Circumvent the Platform to arrange payment for an errand outside the app, or to avoid the escrow, ratings, or dispute process;
- Harass, threaten, discriminate against, or endanger another user;
- Submit false identity information or impersonate another person;
- Post or accept an errand involving illegal goods or activity, or anything that endangers health or safety;
- Manipulate ratings, referrals, promotions, or the matching system, including through multiple accounts or coordinated fake activity;
- Interfere with, reverse-engineer, or disrupt the Platform's normal operation.
In-app chat includes a "Report message" action, and messages are automatically screened for known abusive-language patterns as a first line of defense. Violating this section may result in warning, suspension, or termination of your account under Section 12.
9. Disputes & escrow holds
If either party reports a problem with an errand that has started or completed, the errand moves into a dispute state: any escrow funds tied to that errand — including an already-released partial payment where recoverable — are frozen pending resolution, and a Runner cannot withdraw funds tied to a disputed errand until it is resolved. Both parties may submit evidence through the app. Our support team targets resolving disputes within 48–72 hours, consistent with common marketplace practice, and will release funds fully to the Runner, fully refund the Requester, or split the outcome, based on the evidence submitted. WakaHustle's dispute decision is final as between the Requester and Runner for purposes of releasing escrowed funds, without prejudice to either party's other legal rights.
10. Safety
WakaHustle takes reasonable steps to verify Runner identity before they can accept errands and to apply enhanced checks for higher-risk errand categories, but we cannot guarantee the conduct of any user. If an errand involves food, medicine, or anything consumed or applied to the body, both parties are responsible for exercising ordinary care and for complying with applicable safety and hygiene standards — WakaHustle is not a food-safety or health authority and does not inspect goods handled during an errand. If you feel unsafe at any point, end the interaction and contact local emergency services first, then report it to us through the app.
11. Intellectual property
The WakaHustle name, logo, app, and website — including their design, text, and underlying software — are owned by or licensed to WakaHustle and are protected by applicable intellectual-property law. You may not copy, modify, distribute, or create derivative works from the Platform except as necessary for your own personal, non-commercial use of it as intended. Content you submit (errand descriptions, chat messages, ratings, Business Directory listings) remains yours, but you grant WakaHustle a licence to host, display, and use it as needed to operate and improve the Platform.
12. Suspension & termination
You may stop using the Platform and close your account at any time through the app. We may suspend or terminate your access, immediately and without notice where reasonably necessary, if you breach these Terms, provide false information, engage in conduct that risks the safety of another user or the integrity of the Platform, or where required by law. Termination does not affect either party's rights or obligations that arose before termination — for example, an outstanding withdrawable balance remains yours to claim, and an open dispute is still resolved under Section 9.
13. Disclaimers & limitation of liability
The Platform is provided "as is" and "as available." To the fullest extent permitted by Nigerian law, WakaHustle disclaims all warranties, express or implied, regarding the Platform's operation and the conduct, quality, or outcome of any errand performed by a Runner or requested by a Requester. WakaHustle is not liable for indirect, incidental, or consequential loss arising from your use of the Platform, and our total liability to you for any claim arising from these Terms or the Platform is limited to the amount of fees you paid to WakaHustle in the three months before the claim arose, except where such a limit is not permitted by law or in the case of our own fraud, wilful misconduct, or gross negligence.
Nothing in these Terms excludes or limits liability for death or personal injury caused by proven negligence, fraud, or any other liability that cannot lawfully be excluded or limited under Nigerian law.
14. Indemnity
You agree to indemnify and hold WakaHustle harmless from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or the rights of a third party, except to the extent caused by WakaHustle's own fault.
15. Changes to these Terms
We may update these Terms from time to time — most often to reflect a new feature, clarify existing wording, or comply with a legal requirement. If a change is material, we'll give you reasonable notice in-app or by other means before it takes effect. Continuing to use the Platform after a change becomes effective means you accept the updated Terms.
16. Governing law & dispute resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or your use of the Platform that cannot be resolved informally will first go through good-faith negotiation between the parties; failing that, it will be subject to the exclusive jurisdiction of the courts of Nigeria, without prejudice to either party's right to seek urgent injunctive relief where necessary.
17. General
If any provision of these Terms is found unenforceable, the rest remain in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and WakaHustle regarding the Platform, and supersede any prior agreement on the same subject. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition, or sale of assets.
